NOTICE TO CALIFORNIA RESIDENTS

This Notice to California Residents supplements the Privacy Policy of Blue Water Consulting, LLC (“Blue Water,” “we,” “us,” or “our”) and applies solely to individuals who reside in the State of California. This Notice describes our practices regarding personal information and the rights available to California residents under applicable California privacy laws, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”).

Categories of Personal Information We Collect. Depending upon your interaction with us, we may collect the following categories of personal information:

  • Identifiers, such as name, postal address, email address, telephone number, online identifiers, IP address, and similar identifiers;

  • Professional or employment-related information, such as professional credentials, medical licensure information, employment history, practice information, specialty, qualifications, and other information provided by physicians, healthcare professionals, clinics, or business contacts;

  • Commercial information, such as information regarding services requested, purchased, or considered and other business interactions with us;

  • Internet or other electronic network activity, such as information regarding interaction with our website, browser type, device information, IP address, cookies, and similar technologies;

  • Geolocation information, such as general location information derived from an IP address;

  • Audio, electronic, visual, or similar information, to the extent provided to us or collected through communications with us;

  • Sensitive personal information, where applicable, such as account credentials or other information classified as sensitive personal information under California law; and

  • Inferences, to the extent we create inferences from other information for legitimate business purposes.

We may also collect other information that you voluntarily provide to us.

Sources of Personal Information. We may collect personal information directly from you, from service providers, from publicly available sources, through our website and related technologies, and from other business partners or third parties as permitted by law.

Purposes for Collection and Use. We may collect, use, retain, and disclose personal information for legitimate business and commercial purposes, including to:

  • Provide, administer, and improve our services;

  • Communicate with prospective clients, business partners, and other individuals;

  • Process transactions and maintain business records;

  • Operate, maintain, secure, and improve our website and technology;

  • Detect and prevent fraud, security incidents, and unlawful activity;

We may disclose personal information to service providers, contractors, professional advisors, affiliated entities, technology providers, governmental or regulatory authorities, and other parties where reasonably necessary to operate our business, provide our services, comply with law, or protect our legal rights. We may also disclose personal information in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets, change of control, or similar business transaction.

Sale and Sharing of Personal Information. Blue Water does not sell personal information for monetary consideration. If Blue Water engages in activities that constitute the “sale” or “sharing” of personal information for purposes of cross-context behavioral advertising under California law, California residents may have the right to opt out of such sale or sharing. Blue Water does not knowingly sell or share the personal information of consumers under 16 years of age.

Sensitive Personal Information. Blue Water does not use or disclose sensitive personal information for purposes other than those permitted by applicable California law unless otherwise disclosed at or before the time of collection.

Retention of Personal Information. We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, comply with our legal, regulatory, contractual, professional, and record-retention obligations, resolve disputes, enforce agreements, and protect our legitimate business interests. Retention periods may vary depending upon the nature of the information and the purposes for which it is maintained.

California Privacy Rights. Subject to applicable exceptions and limitations, California residents may have the right to:

  • Know and Access. Request information concerning the categories and specific pieces of personal information we have collected about you, the sources from which the information was collected, the purposes for collecting, using, selling, or sharing the information, and the categories of third parties to whom we disclose it.

  • Delete. Request deletion of certain personal information we have collected about you.

  • Correct. Request correction of inaccurate personal information maintained about you.

  • Opt Out of Sale or Sharing. Direct a business not to sell or share personal information where applicable.

  • Limit Certain Uses of Sensitive Personal Information. Request limitations on certain uses and disclosures of sensitive personal information where applicable.

  • Non-Discrimination. Exercise your California privacy rights without receiving unlawful discriminatory treatment.

Certain information may be exempt from these rights under applicable law.

Exercising Your California Privacy Rights. When submitting a request, please provide sufficient information for us to reasonably verify your identity and understand the nature of your request. We may request additional information where reasonably necessary to verify your identity or authority to make the request. You may designate an authorized agent to submit a request on your behalf as permitted by California law. We may require verification of the agent’s authority and/or direct verification of your identity.

Response to Requests. We will respond to verified consumer requests within the time periods required by applicable law. If additional time is reasonably necessary and permitted by law, we will notify you of the extension and the reason for it.

Global Privacy Control. Where required by applicable law, we will process legally recognized browser-based opt-out preference signals, including Global Privacy Control signals, as requests to opt out of the sale or sharing of personal information for the browser or device through which the signal is communicated.

California “Shine the Light” Law. California residents may also have rights under California Civil Code Section 1798.83 regarding disclosure of certain personal information to third parties for their direct marketing purposes. To the extent applicable, requests concerning such disclosures may be submitted using the contact information below.

Healthcare and Patient Information. Certain medical information, protected health information, and other healthcare-related information may be governed by HIPAA, the California Confidentiality of Medical Information Act, or other federal or state healthcare privacy laws and may be exempt from some or all provisions of the CCPA. This Notice does not alter any rights or obligations applicable to protected health information or medical information under those laws.
